Welcome to Vistara Shipping Freight Broker Co. L.L.C. These Terms and Conditions (“Terms”) govern your use of our website (https://vistarashippingfreightbroker.com/) and the brokerage services we provide.
By requesting a quote or booking a shipment, you agree to be bound by these Terms.
Vistara Shipping Freight Broker Co. L.L.C is a Freight Broker, not a “Freight Forwarder” or a “Common Carrier.”
Our Role: We act as an intermediary between the “Shipper” (You) and the “Carrier” (the trucking, ocean, or air transport company).
No Liability for Transport: We do not transport the cargo. We are not responsible for the acts, omissions, or delays of the Carriers. The Carrier’s own Terms and Conditions and Bill of Lading shall govern the physical transportation.
Estimates: Quotes are based on information provided by you (weight, dimensions, cargo type). Any discrepancy may result in price adjustments by the Carrier.
Validity: Quotes are typically valid for 7 days unless otherwise stated, due to fluctuating fuel surcharges and carrier rates.
Duties & Taxes: Unless explicitly stated, quotes exclude customs duties, VAT, storage fees, or government inspections.
As the Shipper, you represent and warrant that:
Accuracy: All descriptions of the goods, including weight and hazardous materials (HAZMAT) status, are accurate.
Packaging: All goods are packaged and labeled sufficiently to withstand the rigors of transit.
Compliance: You comply with all applicable UAE laws and international export/import regulations.
Payment Due: All invoices are payable in AED (United Arab Emirates Dirham) unless otherwise agreed.
Standard Terms: Payment is due upon receipt of invoice or as per the specific credit terms approved for your Account.
Late Interest: We reserve the right to charge interest on overdue payments at a rate of 5% per annum or the maximum allowed by UAE law.
Limited Liability: Our liability for any loss related to our brokerage service (errors in booking) is limited to the total brokerage fee paid for that specific shipment.
Carrier Liability: Loss or damage to cargo is subject to the Carrier’s liability limits (e.g., Warsaw Convention for air, Hague-Visby for sea).
Insurance Recommendation: We strongly recommend that Shippers purchase All-Risk Cargo Insurance. We can assist in procuring this upon written request, but we are not the insurer.
Timeframe: Any claims for loss or damage must be noted on the Proof of Delivery (POD) and reported to us within 48 hours of delivery.
Process: We will assist you in filing a claim with the Carrier, but the final decision on the claim rests solely with the Carrier’s insurance provider.
We do not broker shipments for:
Illegal drugs, contraband, or counterfeit goods.
Dangerous goods not disclosed at the time of booking.
Any items prohibited by the UAE Federal Customs Authority.
Neither party shall be liable for any delay or failure to perform duties due to causes beyond their reasonable control, including but not limited to: Acts of God, war, port congestion, strikes, pandemics, or government-mandated lockdowns.
These Terms are governed by the federal laws of the United Arab Emirates and the local laws of the Emirate of Dubai. Any disputes shall be subject to the exclusive jurisdiction of the Dubai Courts.
We reserve the right to terminate our services or your Account access immediately if we suspect fraudulent activity, non-payment, or a violation of UAE trade compliance laws.
